Terms & Conditions | Macarne

1. Illegal Activities

Using Macarne's services for illegal purposes or in support of illegal activities is strictly prohibited. This includes any actions deemed illegal by relevant law or court order. Subscribers are responsible for understanding the laws applicable to their use of Macarne services.

2. Provision of Service

Use of our services implies acceptance of our Terms of Service and Acceptable Use Policy. Orders are subject to verification and may be declined at our discretion.

3. Cancellation of Service

Macarne or the Subscriber may cancel the agreement with appropriate notice. IP Transit, BGP, and full rack services require 2 months’ notice. Cancellations must be made via our ticket system.

4. Disconnection of Service

We may suspend or terminate services for non-payment or suspected violations. No credits will be issued during suspension.

5. No Obligation to Monitor

Macarne is not obligated to monitor or notify users of violations.

6. Amendment

We may update this agreement at any time. Continued use after changes constitutes acceptance.

7. Assignment

Subscribers may not assign the agreement without consent. Macarne may assign it freely.

8. Waiver

A waiver of any breach does not constitute a waiver of future breaches.

9. Compliance with Law

Users must comply with U.S. and local laws applicable to their service use.

10. Legal Jurisdiction

This agreement is governed by Texas law. Disputes must be filed in Texas within 1 year.

11. Responsibilities

Subscribers indemnify Macarne from damages due to policy violations. Macarne is not liable for indirect damages, including service outages or data loss.

12. Contact Information

Subscribers must keep contact information up to date and provide ID if requested.

13. Age / Authority

You must be 18 or legally authorized to enter into this agreement.

14. Payment

Payments are due monthly in advance. Disputes must be raised within 30 days. Declined payments incur a fee.

15. Service and Support

Support is limited to network availability. We do not support application-level issues or Sub-Users.

16. Unauthorized Use

Subscribers must secure their accounts and report any unauthorized access.

17. Legal Disclosure

We may disclose user data to authorities or publish WHOIS data as required.

18. SPAM / UCE / UBE

Spamming is prohibited and may result in heavy fines and service termination.

19. AUP Compliance

Subscribers are accountable for their Sub-Users and must ensure compliance with our Acceptable Use Policy.

20. IRC

IRC usage is allowed.

21. Remedies & Waiver

Our remedies are cumulative and do not require immediate action.

22. Trademarks

Macarne trademarks may not be used without permission.

23. Colocation & Insurance

Subscribers are responsible for insuring colocation equipment and paying fees for shipment or hands-on support.

24. Long-Term Commitments

Discounted rates may apply to long-term agreements. We may revise prices with 60 days’ notice or terminate services with 60 days’ notice.
